These Terms of Service ("Terms") form a legal agreement between you and Papagei LLC ("Papagei," "we," "us," or "our") and govern your access to and use of the Papagei mobile application and any related websites, content, and services (together, the "Services"). Please read them carefully. By creating an account, downloading the app, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms should be read together with our Privacy Policy, which explains how we handle your personal information.

1. Who we are

The Services are provided by Papagei LLC, 13 Rue du Général de Gaulle, La Madeleine 59110, France. You can reach us at hallo@getpapagei.app.

2. Eligibility

You must be at least 18 years old (or the equivalent age of majority in your jurisdiction) to use the Services, or the parent or guardian of a minor consenting to and supervising that minor's use. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Your account

Some features require an account. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Let us know promptly at hallo@getpapagei.app if you believe your account has been used without your authorization. You may register or sign in using an email address or, where offered, a third-party login; your use of a third-party login is also subject to that provider's terms.

4. The Services

Papagei is a mobile learning application that helps you prepare for official German language exams at B1 and B2 levels. It includes diagnostic testing across the four modules (Lesen, Hören, Schreiben, Sprechen), exam-style exercises, full mock examinations, AI-powered feedback on speaking and writing, progress tracking, community features, and a structured learning program. We may add, change, or remove features over time.

Papagei is a study aid. We do not administer official examinations, and we are not affiliated with, endorsed by, or acting on behalf of the Goethe-Institut, telc, ÖSD, or any other examination body. Our exercises and mock exams are designed to mirror official formats, but using Papagei does not guarantee that you will pass any exam or achieve any particular result.

5. Free and premium plans

We offer a free plan with a limited set of features and paid subscription plans ("Premium" and "Premium+") that unlock additional features such as Schreiben and Sprechen exercises, instant AI feedback, full mock exams, the Readiness Score, spaced-repetition review, and — on Premium+ — live speaking-partner sessions and human review of your writing. The specific features included in each plan are described in the app and may change. The free plan is offered on an as-is basis and may be modified or discontinued.

6. Subscriptions, billing, and renewals

Paid subscriptions are sold on a recurring basis (for example, monthly or yearly) at the prices shown in the app at the time of purchase. Prices are stated inclusive of applicable VAT where required.

Where you purchase a subscription through the Apple App Store or Google Play, billing is handled by that platform under its own terms, and payment is charged to your platform account. Where you purchase directly, payments are processed by our payment providers, Stripe and RevenueCat, and Papagei does not store your full card details.

Unless you cancel before the end of the current billing period, your subscription renews automatically for another period of the same length, and the then-current price will be charged using your selected payment method. We may adjust prices for future billing periods; where required by law, we will give you advance notice and the opportunity to cancel before the change takes effect.

7. Cancellation and refunds

You can cancel a subscription at any time. After cancellation you keep access to paid features until the end of the billing period you have already paid for, and the subscription will not renew.

If you subscribed through the App Store or Google Play, you must manage or cancel your subscription and request any refunds through that platform, in line with its policies — we are not able to process those refunds directly. If you subscribed directly, contact us at hallo@getpapagei.app. Except where required by applicable law (including any statutory withdrawal rights you may have as a consumer in the EU), payments are generally non-refundable.

8. AI-powered features

Some features rely on artificial intelligence provided through third parties, including Microsoft Azure AI and OpenAI, to transcribe speech and evaluate your writing and speaking. To provide these features, your submissions are shared with and processed by these providers as described in our Privacy Policy. AI-generated feedback and scores are automated estimates intended to support your study; they may contain errors and are not an official assessment or a prediction of your official exam result. You should use your own judgment and, where appropriate, seek guidance from a qualified teacher.

9. Community and speaking-partner features

The Services may let you connect with other learners and, on Premium+, book live sessions with speaking partners. You are responsible for how you interact with others and for the content you share. Speaking partners and other users are not employees of Papagei unless we state otherwise, and we do not guarantee the accuracy of any feedback they provide. We may moderate, limit, or remove access to community features to protect users or the integrity of the Services.

The Services, including the app, its content, design, text, graphics, and software, are owned by Papagei or our licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial exam preparation. We reserve all rights not expressly granted. "Papagei" and our logo are our trademarks; other names and marks are the property of their respective owners.

12. Your content

You keep ownership of the content you submit, such as your writing and speaking recordings. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and display that content as needed to operate and improve the Services and to provide the features you request (including sending it to our AI providers for evaluation). You are responsible for ensuring you have the rights to the content you submit.

13. Third-party services

The Services rely on and may link to third parties, including Apple, Google, Stripe, RevenueCat, Microsoft Azure AI, and OpenAI. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. If any content or exercise references an examination body or its formats, that reference is descriptive only and does not imply any partnership or endorsement.

14. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure, that content will be accurate, or that using the Services will lead to any particular exam outcome. Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded or limited under applicable law.

15. Limitation of liability

To the fullest extent permitted by law, Papagei and its representatives will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Services. To the extent we are found liable, our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the twelve (12) months before the claim, or fifty euros (€50). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Papagei and its representatives from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising from your misuse of the Services, your violation of these Terms, or your infringement of any third party's rights.

17. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Services or other users. When your account ends, your right to use the Services stops, and we will handle your data as described in our Privacy Policy. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

18. Changes to the Services and these Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you in the app or by email. Changes take effect when posted unless stated otherwise. Your continued use of the Services after changes take effect means you accept the updated Terms; if you do not agree, you should stop using the Services.

19. Governing law

These Terms are governed by French law, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rules of the country where you live. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
